Without proper instruction, effectively building a criminal case from a traffic stop can appear complicated and overwhelming. Officers are often shortchanged and have trouble knowing what laws coincide with applicable offenses. Understanding traffic law is crucial in order to be an effective and proactive police officer. Many of our greatest apprehensions begin on the foundational principles of understanding traffic law. “The Total Traffic Stop – Montana Edition” is meant to enhance every Montana police officer’s knowledge of traffic statutes and associated case law, while also providing an extreme gain in confidence. This course also provides a deep dive into the legalities and best practices for obtaining the ability to search a vehicle, whether that be through consent, a search warrant, or an exception to the written warrant requirement.
Mistakes and embarrassments occur when police officers lack the education to know what they should be doing. This 2-day course is designed to provide clarification in relation to questions and myths on what officers can and cannot do. The course entails unique and little-known laws and case law that many officers are unaware of. Additionally, it will provide a comprehensive understanding of how to utilize the correct laws and precedents in all settings. This is to include, but not limited to, traffic enforcement, patrol functions, criminal interdiction, and impaired driving. In terms of suppression of criminal cases, the first thing defense attorneys argue is the motor vehicle violation and its proper application. The second being the legality of the search of the vehicle. This course is critical to ensure cases stemming from traffic stops are built on a solid foundation, rather than a guessing game.
